Order Cancellations by Buyer

Orders may be canceled within 12 hours of placement by contacting our support team at support@pointerusa.com.

Order Cancellation by Seller

We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household, or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address.

In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e‑mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers, or distributors.

You agree to provide current, complete, and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

Intellectual Property

The Buyer shall not modify, alter, or create derivative works from the Seller’s intellectual property without prior written consent. The Buyer shall not use the Seller’s intellectual property in any manner that is likely to cause confusion, mistake, or deception among consumers or in any manner that disparages or discredits the Seller.

Protection

The Buyer agrees to assist the Seller in protecting and maintaining the Seller’s intellectual property rights. This includes notifying the Seller of any unauthorized use or infringement.

Indemnification

The Buyer agrees to indemnify and hold harmless the Seller from any claims, damages, or expenses arising from the Buyer’s unauthorized use of the Seller’s intellectual property.

Disclaimer of Warranties and Limitation of Liability

Exclusion of Damages

In no event shall either party be liable to the other for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, revenue, data, or business opportunities, arising out of or related to this sales order, even if the party has been advised of the possibility of such damages.

Force Majeure

Neither party shall be liable for any failure or delay in performance under this sales order due to circumstances beyond its reasonable control, including but not limited to acts of God, war, terrorism, labor disputes, and governmental actions.

Our products are designed for safe and educational use. However, we are not liable for misuse or accidents involving our products.

Severability

If any provision of these Terms and Conditions is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be deemed severed and shall not affect the validity and enforceability of the remaining provisions. The remaining provisions shall remain in full force and effect, and the invalid, illegal, or unenforceable provision shall be replaced by a valid, legal, and enforceable provision that most closely matches the intent of the original provision.

This clause shall be interpreted in accordance with the laws of the State of California and the United States.
